Die Schweiz hat 2012 CO2-Emissionsvorschriften f\u00fcr neue Personenwagen eingef\u00fchrt mit dem Ziel, die CO2-Emissionen von neuen Personenwagen bis Ende 2015 auf durchschnittlich 130 g CO2\/km zu senken. Wenn die durchschnittlichen CO2-Emissionen aller Fahrzeuge eines Importeurs diese Zielvorgabe \u00fcberschreiten, stellt der Bund eine entsprechende CO2-Sanktion in Rechnung. Die Erfassung der Importe, die Rechnungsstellung f\u00fcr die CO2-Sanktion und das Inkasso erfolgt durch das Bundesamt f\u00fcr Energie (BFE) und das Astra.<\/p>\n

Gest\u00fctzt auf eine Strafanzeige des Astra er\u00f6ffnete die Bundesanwaltschaft im September 2017 ein Strafverfahren gegen den Astra-Mitarbeiter und dehnte dieses wenig sp\u00e4ter auf die beiden Verwaltungsr\u00e4te aus, wie diese soeben mitgeteilt hat. Nach umfangreichen Ermittlungen habe die Bundesanwaltschaft den ehemaligen Astra-Mitarbeiter nun wegen mehrfacher Urkundenf\u00e4lschung im Amt (Art. 317 Ziff. 1 des Strafgesetzbuches, StGB), mehrfachen Sich bestechen lassens (Art. 322quater StGB), gewerbsm\u00e4ssigen Abgabebetrugs (Art. 14 Abs. 4 des Verwaltungsstrafrechts, VStrR) sowie mehrfachen Erschleichens einer falschen Beurkundung (Art. 15 Ziff. 1 VStrR) angeklagt. Den beiden anderen Beschuldigten wird mehrfache Anstiftung zu Urkundenf\u00e4lschung im Amt (Art. 317 Ziff. 1 in Verbindung mit Art. 24 Abs. 1 StGB), mehrfaches Bestechen (Art. 322ter StGB), gewerbsm\u00e4ssiger Abgabebetrug (Art. 14 Abs. 4 VStrR) und mehrfaches Erschleichen einer falschen Beurkundung (Art. 15 Ziff. 1 VStrR) vorgeworfen.\u00a0<\/strong><\/p>\n

Falscherfassung und Manipulation von Daten<\/strong><\/p>\n

Der ehemalige Astra-Mitarbeiter war von Mai 2012 bis September 2017 als technischer Sachbearbeiter in der dortigen Abteilung Strassenverkehr angestellt. Ihm wird vorgeworfen, in der Zeit von Juni 2014 bis September 2017 die f\u00fcr die CO2-Sanktionserhebung massgebenden Daten in den Computersystemen des Astra zugunsten der vorgenannten Fahrzeug-Import-Gesellschaft manipuliert zu haben. Im Gegenzug sollen ihm die beiden Verwaltungsr\u00e4te monatlich einen Bargeldbetrag von 2’000 Franken \u00fcbergeben haben. Durch dieses Vorgehen musste die Fahrzeug-Import-Gesellschaft f\u00fcr die Jahre 2015 bis 2017 keine CO2-Sanktionen f\u00fcr die von ihr importierten Personenwagen entrichten. Bei wahrheitsgetreuer Datenerfassung w\u00e4ren in diesem Zeitraum CO2-Sanktionen in der H\u00f6he von rund 9 Millionen Franken angefallen, wie die Bundesanwaltschaft schreibt.<\/p>\n

Die Strafantr\u00e4ge gibt die BA wie \u00fcblich anl\u00e4sslich der Hauptverhandlung vor dem Bundesstrafgericht bekannt. Mit Einreichung der Anklageschrift ist das Bundesstrafgericht in Bellinzona f\u00fcr die weitere Information der Medien zust\u00e4ndig. Bis zum Vorliegen eines rechtskr\u00e4ftigen Urteils gilt die Unschuldsvermutung.<\/p>\n
