(Symbolbild; Unsplash.com)<\/figcaption>\r\n<\/figure>\r\n<p>Das Nationale Testinstitut f\u00fcr Cybersicherheit NTC testet, was sonst nicht getestet wird. Es untersucht digitale Produkte und Infrastrukturen auf Schwachstellen, die nicht oder nicht ausreichend gepr\u00fcft werden \u2013 auch auf eigene Initiative. Das Problem: Die Durchf\u00fchrung von Schwachstellenanalysen steht \u2013 sofern sie das (versuchte oder erfolgte) Eindringen in eine fremde Datenverarbeitungsanlage (Penetrationstests) beinhaltet \u2013 in potenziellem Konflikt mit dem Hacker-Tatbestand von Art. 143bis Abs. 1 StGB. Demgem\u00e4ss wird bestraft, \u00abwer auf dem Wege von Daten\u00fcbertragungseinrichtungen unbefugterweise in ein fremdes, gegen seinen Zugriff besonders gesichertes Datenverarbeitungssystem eindringt\u00bb. Kurz: Ohne ausdr\u00fccklichen Auftrag und ohne Einwilligung ist das Aufsp\u00fcren von Sicherheitsl\u00fccken nach schweizerischem Recht strafbar, sobald die Zugangssicherung eines fremden Systems \u00fcberwunden oder der Versuch dazu unternommen wird. Zudem stellt das Strafgesetzbuch die Manipulation und Ver\u00e4nderung von Daten unter Strafe.<\/p>\r\n<h3>Rechtfertigender Notstand<\/h3>\r\n<p>Wird im Rahmen von Schwachstellenanalysen gegen Strafnormen verstossen, kann man sich unter bestimmten Umst\u00e4nden auf den rechtfertigenden Notstand nach Art. 17 StGB berufen. Das Eindringen in ein System ist nur gerechtfertigt, wenn konkrete Hinweise vorliegen, dass ein System von potenziellen Sicherheitsl\u00fccken betroffen ist. Zudem muss die Aufdeckung, Dokumentation und Information \u00fcber diese Sicherheitsl\u00fccken den Zweck erf\u00fcllen, b\u00f6swillige Zugriffe abzuwenden. In subjektiver Hinsicht ist vorausgesetzt, dass der Notstandsberechtigte die Notstandslage kennen muss und handelt, um das bedrohte Rechtsgut zu retten.<\/p>\r\n<h3>Ver\u00f6ffentlichung der Ergebnisse von Schwachstellenanalysen<\/h3>\r\n<p>Vor einer detaillierten Ver\u00f6ffentlichung sollten die identifizierten und dokumentierten Sicherheitsl\u00fccken vollst\u00e4ndig behoben sein. Ist dies nicht der Fall, sollte der Detaillierungsgrad einer Ver\u00f6ffentlichung auf die notwendigen Informationen reduziert werden. Damit werden Systemnutzer angemessen gewarnt und es wird ihnen die M\u00f6glichkeit gegeben, sich zu sch\u00fctzen.<\/p>\r\n<p>Mit der Ver\u00f6ffentlichung des Rechtsgutachtens leistet das NTC einen Beitrag zur aktuellen Nationalen Cyberstrategie des Bundes, die ethisches Hacking institutionalisieren will. Das Test- und Pr\u00fcflabor im Kanton Zug arbeitet eng mit Forschungseinrichtungen, privaten Unternehmen der Cybersicherheit und internationalen Experten zusammen.
