Die Agentur C verbreitet in der Schweiz Bibelverse auf Plakaten. Sie beauftragte ihre Vertragspartnerin APG|SGA 2022 bei der STI Bus AG Werbung in und auf Bussen platzieren zu lassen. Die Verkehrsbetriebe lehnten dies Ende August 2023 ab und verwiesen die Agentur auf ihren Vertrag mit der APG.<\/p>\r\n

Sie hielten zudem fest, dass sie sich nicht veranlasst sehen, eine anfechtbare Verf\u00fcgung zu erlassen, wie dies die Agentur gew\u00fcnscht hatte.<\/p>\r\n

Der Anwalt der Agentur gelangte in der Folge an das Amt f\u00fcr \u00f6ffentlichen Verkehr und Verkehrskoordination des Kantons Bern, das sich nicht zur Sache \u00e4ussern wollte. Dies geht aus einem am Donnerstag ver\u00f6ffentlichten Urteil des Bundesverwaltungsgerichts hervor.<\/p>\r\n

Nicht zust\u00e4ndig<\/strong><\/h3>\r\n

Die Rechtsverweigerungsbeschwerde beim Bundesamt f\u00fcr Verkehr (BAV) brachte die Agentur nicht weiter, denn das Amt ist f\u00fcr die Behandlung nicht zust\u00e4ndig und leitete den Fall ans Bundesverwaltungsgericht weiter.<\/p>\r\n

Dieses ist nicht eingetreten, denn die Frist von 30 Tagen f\u00fcr die \u00dcbermittlung eines solchen Rechtsmittels ist abgelaufen. Das Gericht schreibt, dass die im August 2023 bereits anwaltlich vertretene Beschwerdef\u00fchrerin nach dem Schreiben der STI Bus ihre Beschwerde h\u00e4tte einreichen m\u00fcssen.
