Das Kantonsgericht Zug hat die Klage von Jolanda Spiess-Hegglin auf Gewinnherausgabe gegen Ringier erstinstanzlich mehrheitlich gutgeheissen. Das Urteil sieht vor, dass Ringier CHF 309\u2019531 von den geforderten CHF 431\u2019527 an die Kl\u00e4gerin abf\u00fchrt. Ringier bem\u00e4ngelt jedoch, dass die Entscheidung weitgehend die offen gelegten Gesch\u00e4ftszahlen und ein Gutachten von PwC ignoriert habe. Laut Ringier belaufe sich der tats\u00e4chlich erzielte Gewinn auf einen Bruchteil der zugesprochenen Summe.<\/p>\r\n

Bereits 2020 hatte das Kantonsgericht Zug best\u00e4tigt, dass der Blick mit der damaligen Berichterstattung die Pers\u00f6nlichkeitsrechte der ehemaligen Kantonsr\u00e4tin verletzt habe \u2013 ein Urteil, das Ringier akzeptierte. Das nun gef\u00e4llte Urteil zur Gewinnherausgabe ist aus Sicht des Medienunternehmens gef\u00e4hrlich: \u00abDieses Urteil gef\u00e4hrdet die Medienfreiheit in unserem Land\u00bb, so Heimgartner. \u00abWenn Journalismus solche Strafzettel drohen, wird die Bereitschaft zu kritischer Berichterstattung stark eingeschr\u00e4nkt.\u00bb<\/p>\r\n
