Accueilli par Kurt Mettler, directeur de SIZ Care AG, et par l'animateur Michael Sokoll, le public a d'abord re\u00e7u une le\u00e7on sur le th\u00e8me \"Se plaindre met votre sant\u00e9 en danger\" : Dani Nieth, formateur en communication et auteur de livres, a expliqu\u00e9 comment une trop forte focalisation sur le n\u00e9gatif ouvre la porte aux bact\u00e9ries et aux virus.<\/p>\n<h2>Pr\u00e9vention et inclusion dans la pratique<\/h2>\n<p>L'expos\u00e9 suivant portait concr\u00e8tement sur la pr\u00e9vention et l'insertion. Dr J\u00e9r\u00f4me Cosandey d'Avenir Suisse a pr\u00e9sent\u00e9 dans son expos\u00e9 \"R\u00e9int\u00e9grer au lieu d'exclure - une bonne int\u00e9gration professionnelle en cas d'invalidit\u00e9 vaut la peine\" les r\u00e9sultats d'une \u00e9tude r\u00e9cente qui prouve pr\u00e9cis\u00e9ment cela. Il a \u00e9galement soulign\u00e9 que des instruments tels que le profil de r\u00e9adaptation ax\u00e9 sur les ressources (REP), tel qu'il a \u00e9t\u00e9 d\u00e9velopp\u00e9 par <a href=\"http:\/\/www.compasso.ch\">Compasso<\/a>Les services de la Commission europ\u00e9enne ont \u00e9galement \u00e9t\u00e9 mis \u00e0 profit pour d\u00e9velopper un r\u00e9seau de maintien dans l'emploi et d'insertion professionnelle.<\/p>\n<p>Le Dr Jochen Uebel, sp\u00e9cialiste en psychiatrie et psychoth\u00e9rapie \u00e0 la clinique Sch\u00fctzen \u00e0 Aarau, a ensuite pos\u00e9 un regard psychiatrique sur l'(in)aptitude au travail. Il a soulign\u00e9 qu'il s'agissait ici de questions de m\u00e9decine. <em>et<\/em> Il a donc plaid\u00e9 pour une \"alliance th\u00e9rapeutique\" entre tous les acteurs, c'est-\u00e0-dire les m\u00e9decins, les employeurs, les assureurs et les patients. Cela implique entre autres une attitude plus orient\u00e9e vers le travail de la part des professionnels de la sant\u00e9 et une approche individuelle de la r\u00e9insertion dans le processus de travail.<\/p>\n<h2>Les pi\u00e8ges juridiques du maintien du salaire<\/h2>\n<p>L'expos\u00e9 de Kurt Mettler a ensuite port\u00e9 sur les ambigu\u00eft\u00e9s du maintien du salaire et des indemnit\u00e9s journali\u00e8res en cas de maladie. Il a soulign\u00e9 la diff\u00e9rence de classification de l'incapacit\u00e9 de travail dans le droit des assurances sociales (en particulier l'art. 6 LPGA) et dans le droit des obligations (art. 324a CO). Le droit des assurances sociales rattache explicitement une incapacit\u00e9 de travail \u00e0 une maladie, alors que le droit des obligations parle d'\"emp\u00eachement de travailler\". Cette derni\u00e8re argumentation peut avoir pour cons\u00e9quence que les assureurs d'indemnit\u00e9s journali\u00e8res en cas de maladie ne consid\u00e8rent pas un emp\u00eachement de travailler comme une maladie et ne veulent donc pas verser d'indemnit\u00e9s journali\u00e8res. C'est pourquoi il est recommand\u00e9, en tant que \"solution de remplacement\", de r\u00e9gler clairement la poursuite du versement du salaire par l'employeur au niveau du contrat de travail\/r\u00e8glement du personnel, afin de parer \u00e0 de telles ambigu\u00eft\u00e9s.<\/p>\n<h2>Plus de \"crises d'amidon\"<\/h2>\n<p>L'expos\u00e9 d'Evelyne Wenzel a constitu\u00e9 le point final. Elle a donn\u00e9 au public des pistes de r\u00e9flexion sur la mani\u00e8re de renforcer ses propres points forts par le biais de l'image de soi, d'une vision porteuse de sens et d'objectifs clairs ainsi que d'un \u00e9tat d'esprit positif.
