Un cas comme il peut s'en produire souvent : Maria et Daniel se sont inscrits au service de livraison en ligne d'une cha\u00eene de supermarch\u00e9s et ont accept\u00e9 pour cela les conditions d'utilisation des donn\u00e9es de l'entreprise - un document long comme le bras et difficile \u00e0 comprendre. D\u00e8s lors, la famille re\u00e7oit presque quotidiennement, \u00e0 son grand dam, de la publicit\u00e9, non seulement de la cha\u00eene de supermarch\u00e9s, mais aussi de sa filiale. \"Ont-ils le droit de faire \u00e7a ?\", se demandent Maria et Daniel. Souvent, seul(e) un(e) juriste peut r\u00e9pondre \u00e0 cette question.<\/p>\n

Un chatbot comme avocat IA<\/h2>\n

Maria, Daniel et leur newsletter sont bien s\u00fbr fictifs. Mais tout le monde conna\u00eet probablement de tels exemples dans la vie quotidienne. \"Les consommateurs ne savent souvent pas ce que les entreprises ont le droit de faire avec leurs donn\u00e9es et comment ils peuvent se d\u00e9fendre contre une utilisation ind\u00e9sirable de ces donn\u00e9es\", explique le juriste Michiel Van Roey, cofondateur de Profila, une plateforme internationale sp\u00e9cialis\u00e9e dans la protection des donn\u00e9es, la fid\u00e9lisation de la client\u00e8le et le marketing.<\/p>\n

La Haute \u00e9cole de Lucerne et Profila travaillent sur un projet commun visant \u00e0 changer cela : Les chercheurs veulent mettre \u00e0 la disposition de Maria et Daniel une sorte d'\"avocat IA\" qui les soutiendra par ses conseils professionnels. L'avocat se pr\u00e9sente sous la forme d'une application chatbot pour smartphones, comparable aux assistants num\u00e9riques tels que Siri ou Alexa.<\/p>\n

Le chatbot fournira aux utilisateurs des informations sur la mani\u00e8re dont les entreprises utilisent leurs donn\u00e9es, sous la forme de Q&A compr\u00e9hensibles par les non-initi\u00e9s. Il pourra \u00e9galement les aider \u00e0 g\u00e9rer leurs donn\u00e9es : \"Les consommateurs doivent pouvoir d\u00e9terminer plus facilement eux-m\u00eames qui a acc\u00e8s \u00e0 leurs donn\u00e9es personnelles et \u00e0 quelles fins celles-ci sont utilis\u00e9es\", explique Michel Van Roey - dans le cas de Maria et Daniel, il s'agit donc de savoir si une filiale de la cha\u00eene de supermarch\u00e9s peut leur envoyer de la publicit\u00e9.<\/p>\n

\"Les r\u00e9ponses juridiques doivent \u00eatre pr\u00e9cises\"<\/h2>\n

Derri\u00e8re l'avocat IA se cache une base de donn\u00e9es intelligente d\u00e9velopp\u00e9e \u00e0 la Haute \u00e9cole de Lucerne. L'\u00e9quipe de recherche d'Alexander Denzler, du d\u00e9partement Informatique, \"alimente\" l'algorithme de la base de donn\u00e9es avec pr\u00e8s d'un million de documents au total, des cas juridiques et des jugements des tribunaux aux conditions g\u00e9n\u00e9rales d'affaires des entreprises, en passant par les directives d'utilisation des donn\u00e9es des autorit\u00e9s et des associations. Plus le syst\u00e8me dispose de donn\u00e9es, mieux il apprend \u00e0 r\u00e9pondre \u00e0 des cas sp\u00e9cifiques, comme l'explique Denzler.
\nPour les chercheurs en informatique, la reconnaissance vocale repr\u00e9sente un d\u00e9fi particulier. En effet, la plupart des utilisateurs ne connaissent pas les termes juridiques. \"Notre intelligence artificielle doit malgr\u00e9 tout \u00eatre en mesure de comprendre quels probl\u00e8mes juridiques se cachent derri\u00e8re une question\", explique Denzler. \"Lorsqu'il s'agit de questions juridiques, les r\u00e9ponses doivent \u00eatre pr\u00e9cises\".<\/p>\n

En cas de doute, l'homme prend le relais<\/h2>\n

Afin de s'assurer que l'avocat IA fonctionne correctement et ne se r\u00e9v\u00e8le pas \u00eatre un avocat num\u00e9rique angulaire, les juristes de Profila examineront la base de donn\u00e9es sous toutes les coutures au moyen de questions test. Une premi\u00e8re version capable de comprendre et de r\u00e9pondre aux questions de mani\u00e8re fiable devrait \u00eatre pr\u00eate \u00e0 l'\u00e9t\u00e9 2022. Plus le programme sera utilis\u00e9, plus il pourra se baser sur de nouveaux cas et donc de nouvelles donn\u00e9es.<\/p>\n

Alexander Denzler souligne qu'il y aura toujours des situations o\u00f9 l'avocat IA ne pourra pas fournir de r\u00e9ponse satisfaisante, parce que les questions sont trop sp\u00e9cifiques ou n'ont jamais \u00e9t\u00e9 pos\u00e9es. L'IA manque donc tout simplement de donn\u00e9es de r\u00e9f\u00e9rence. Dans de tels cas, le chatbot pr\u00e9sentera aux utilisateurs une courte liste de juristes sp\u00e9cialis\u00e9s dans le domaine en question, qui pourront fournir des informations en temps utile moyennant une somme d'environ 10 francs par question. L'expertise de ces professionnels sera d\u00e9termin\u00e9e sur la base de leur CV et de leurs activit\u00e9s ant\u00e9rieures sur l'application.<\/p>\n

Financement de projets par la Conf\u00e9d\u00e9ration<\/h2>\n

D\u00e8s que la base de donn\u00e9es intelligente sera pr\u00eate, l'\u00e9quipe de recherche commencera \u00e0 mettre en place un r\u00e9seau de juristes qui participeront \u00e0 l'application Profila. L'objectif est d'achever le projet d'ici 2023. La premi\u00e8re version de l'appli ne comprendra que les questions en allemand. Si elle fait ses preuves, Alexander Denzler et Michiel Van Roey esp\u00e8rent pouvoir d\u00e9velopper dans un deuxi\u00e8me temps une version pour d'autres march\u00e9s nationaux.<\/p>\n

L'agence f\u00e9d\u00e9rale pour l'innovation Innosuisse finance le projet, pr\u00e9vu sur deux ans, \u00e0 hauteur de 550'000 francs. Au total, le volume du projet s'\u00e9l\u00e8ve \u00e0 950'000 francs.<\/p>\n
