(Image : VFAS)<\/figcaption><\/figure>\n<p>Le pouvoir de march\u00e9 des quelques constructeurs automobiles et de leurs importateurs s'est toujours r\u00e9v\u00e9l\u00e9 \u00eatre un danger latent pour les plus de 5000 PME concessionnaires\/garages en Suisse. Des infractions au droit des cartels ont \u00e9t\u00e9 commises \u00e0 plusieurs reprises : Les fabricants ont tent\u00e9 d'isoler le march\u00e9 suisse de l'\u00e9tranger en emp\u00eachant ou en rendant plus difficile l'importation parall\u00e8le ou directe. Il est \u00e9galement arriv\u00e9 que des garanties soient refus\u00e9es sur des v\u00e9hicules import\u00e9s ou que des garages ind\u00e9pendants ne soient pas approvisionn\u00e9s en pi\u00e8ces de rechange. L'acc\u00e8s technique aux diagnostics sp\u00e9cifiques \u00e0 la marque ou aux carnets d'entretien \u00e9lectroniques est refus\u00e9. Les droits des concessionnaires sont r\u00e9duits.<\/p>\n<p>Ce \"registre des p\u00e9ch\u00e9s\", comme l'\u00e9num\u00e8re l'Association du commerce automobile ind\u00e9pendant suisse VFAS, est long. Les consommateurs et les PME suisses sont les victimes de ces d\u00e9rives : il y a moins de choix \u00e0 des prix plus \u00e9lev\u00e9s et des entraves pour les consommateurs et les PME (\"\u00eelot de chert\u00e9 suisse\"). C'est pourquoi la COMCO a publi\u00e9 en 2002 une communication sur les v\u00e9hicules automobiles contenant de nombreuses dispositions relatives \u00e0 la protection des commer\u00e7ants et des consommateurs. Cependant, ces dispositions n'ont que rarement \u00e9t\u00e9 appliqu\u00e9es dans la pratique, faute de caract\u00e8re contraignant pour les tribunaux.<\/p>\n<h3>Le chemin vers la modification de la loi<\/h3>\n<p>En 2018, le conseiller national Gerhard Pfister a d\u00e9pos\u00e9 une motion (n\u00b0 18.3898) dans le but d'int\u00e9grer la communication de la COMCO dans une ordonnance sur les v\u00e9hicules automobiles et de la rendre ainsi contraignante pour les tribunaux et les autorit\u00e9s - comme dans l'UE. La motion a \u00e9t\u00e9 soutenue par une large alliance sous la direction politique de la VFAS avec les associations UPSA, ACS, Carrosserie Suisse, SAA, VSS, 2roues Suisse, Unia et Syna. Le Conseil national et le Conseil des Etats ont approuv\u00e9 la motion. La nouvelle ordonnance entrera d\u00e9sormais en vigueur le 1er janvier 2024.<\/p>\n<h3>Quels droits pour les PME et les consommateurs ?<\/h3>\n<p>A partir du 1er janvier 2024, les comportements suivants des fabricants\/importateurs seront notamment consid\u00e9r\u00e9s comme une infraction \u00e0 la loi sur les cartels :<\/p>\n<ul>\n<li>des entraves aux importations, par exemple en rendant plus difficile l'octroi de la garantie du fabricant.<\/li>\n<li>restrictions de distribuer des v\u00e9hicules d'autres marques<\/li>\n<li>les restrictions \u00e0 l'acc\u00e8s aux pi\u00e8ces de rechange d'origine et au droit d'utiliser des pi\u00e8ces de rechange d'origine \u00e9quivalentes sans risquer de perdre la garantie<\/li>\n<li>Restrictions d'acc\u00e8s \u00e0 tous les types d'outils m\u00e9caniques et num\u00e9riques n\u00e9cessaires \u00e0 l'entretien des v\u00e9hicules.<\/li>\n<li>les restrictions d'acc\u00e8s \u00e0 l'information et \u00e0 la formation professionnelle.<\/li>\n<li>Restrictions \u00e0 effectuer des services et des r\u00e9parations sur des v\u00e9hicules import\u00e9s sous garantie d'usine.<\/li>\n<li>Refus d'un contrat de service si le concessionnaire ind\u00e9pendant ou de marque r\u00e9pond \u00e0 toutes les normes du constructeur.<\/li>\n<\/ul>\n<p>Le pr\u00e9sident de la VFAS, Roger Kunz, se montre tr\u00e8s heureux d'avoir \u00e9t\u00e9 le moteur de la demande du Parlement suisse : \"Pour la VFAS, la protection des concessionnaires et garages automobiles suisses et des automobilistes est essentielle. L'engagement a port\u00e9 ses fruits. D\u00e9sormais, les r\u00e8gles automobiles de la COMCO reposent sur une base l\u00e9gale contraignante\". L'association d\u00e9fend depuis 1956 les int\u00e9r\u00eats du commerce automobile ind\u00e9pendant et libre en Suisse. Elle s'oppose \u00e0 toutes les restrictions et entraves au commerce automobile libre. Selon les enqu\u00eates de la VFAS, les importations directes et parall\u00e8les g\u00e9n\u00e8rent une valeur ajout\u00e9e annuelle de 1,5 milliard de francs suisses pour l'\u00e9conomie nationale.<\/p>\n<p><em>Source : VFAS<\/em><\/p>","protected":false},"excerpt":{"rendered":"<p>L'actuelle communication sur les v\u00e9hicules automobiles de la Commission de la concurrence (COMCO) contient des dispositions centrales de protection des concessionnaires et des droits des consommateurs au sein de la branche automobile. A partir du 1er janvier 2024, ces r\u00e8gles deviendront obligatoires pour toutes les autorit\u00e9s et tous les tribunaux, comme dans l'UE, sous la forme d'une ordonnance du Conseil f\u00e9d\u00e9ral sur les v\u00e9hicules automobiles.
