Concr\u00e8tement, il s'agit de la g\u00e9othermie et de l'extraction de gaz naturel.<\/p>\n<p>Comme il existe toujours des lacunes l\u00e9gislatives dans ce domaine, le Conseil d'Etat zurichois a \u00e9labor\u00e9 une loi sur l'utilisation du sous-sol.<\/p>\n<p><strong>Production d'\u00e9nergie autour des ressources min\u00e9rales<\/strong><br \/>\nL'objectif de la loi est de pr\u00e9server la population et l'environnement de tout dommage et de cr\u00e9er une s\u00e9curit\u00e9 juridique pour les entrepreneurs et les investisseurs. Des conditions-cadres claires doivent favoriser l'utilisation du sous-sol pour la production d'\u00e9nergie locale. Pour ce faire, la loi cr\u00e9e notamment des comp\u00e9tences pr\u00e9cises et une proc\u00e9dure transparente.<\/p>\n<p>L'objet de la loi est l'\u00e9tude du sous-sol (\u00e9tudes g\u00e9ologiques et g\u00e9ophysiques telles que fouilles, forages et \u00e9tudes sismiques) ainsi que son utilisation, en particulier la production d'\u00e9nergie \u00e0 grande \u00e9chelle (par exemple centrales g\u00e9othermiques, extraction de gaz naturel), mais aussi l'extraction ou l'exploitation d'autres ressources naturelles ainsi que le stockage de gaz dans le sous-sol (par exemple gaz naturel ou CO2).<\/p>\n<p><strong>Souverainet\u00e9 du canton<\/strong><br \/>\nLa loi pr\u00e9cise que la souverainet\u00e9 sur le sous-sol appartient au canton et que les concessions pour l'exploitation des ressources mini\u00e8res doivent faire l'objet d'un appel d'offres public, d\u00e9finit la proc\u00e9dure d'octroi des autorisations et des concessions et exige que l'exploitation du sous-sol soit coordonn\u00e9e avec les cantons voisins.<\/p>\n<p><strong>L'environnement et l'homme en ligne de mire<\/strong><br \/>\nEn outre, la loi pr\u00e9cise que l'exploration et l'exploitation du sous-sol doivent toujours se faire sans danger pour l'homme et l'environnement, conform\u00e9ment \u00e0 la l\u00e9gislation en vigueur, quel que soit le proc\u00e9d\u00e9 utilis\u00e9. En revanche, elle ne se prononce pas sur des technologies sp\u00e9cifiques comme la fracturation. Cela n'aurait pas de sens compte tenu de l'\u00e9volution constante de la technologie.<br \/>\nGr\u00e2ce \u00e0 des r\u00e8gles sur les garanties et la responsabilit\u00e9, la loi \u00e9vite que d'\u00e9ventuels dommages \u00e0 l'environnement ou \u00e0 la propri\u00e9t\u00e9 ne soient pas couverts ou que l'\u00c9tat doive r\u00e9pondre d'activit\u00e9s priv\u00e9es.<\/p>\n<p><strong>Les donn\u00e9es doivent appartenir au public<\/strong><br \/>\nNon seulement le sous-sol lui-m\u00eame appartient au public, mais les connaissances acquises par l'\u00e9tude et l'exploitation du sous-sol doivent \u00e9galement lui appartenir. Selon le projet de loi, toutes les donn\u00e9es g\u00e9ologiques et hydrog\u00e9ologiques concernant le sous-sol doivent \u00eatre mises gratuitement \u00e0 la disposition du canton. Le canton peut mettre ces donn\u00e9es \u00e0 la disposition d'autres institutions publiques et d'instituts de recherche. Apr\u00e8s un d\u00e9lai de blocage de trois ans, les donn\u00e9es peuvent \u00eatre rendues accessibles au public avec les \u00e9valuations correspondantes.<\/p>\n<p>Le Conseil d'Etat a autoris\u00e9 la direction des travaux publics \u00e0 mener une proc\u00e9dure de consultation sur le projet de loi.
