Le 15 f\u00e9vrier 2017, le Conseil f\u00e9d\u00e9ral a adopt\u00e9 le message relatif \u00e0 la r\u00e9vision totale de la loi f\u00e9d\u00e9rale sur les march\u00e9s publics (LMP). L'un des principaux objectifs de cette r\u00e9vision est d'harmoniser les r\u00e9glementations de la Conf\u00e9d\u00e9ration et des cantons en mati\u00e8re de march\u00e9s publics. Parall\u00e8lement, le Conseil f\u00e9d\u00e9ral a \u00e9galement adopt\u00e9 le message relatif \u00e0 la r\u00e9vision de l'accord de l'OMC sur les march\u00e9s publics de 2012 (AMP). Le nouvel accord am\u00e9liore la transparence et l'acc\u00e8s au march\u00e9 et remplace l'accord initial de 1994. Fin janvier 2018, la Commission de l'\u00e9conomie du Conseil national (CER-N) a pris quelques d\u00e9cisions novatrices lors de son examen d\u00e9taill\u00e9, notamment en ce qui concerne l'attribution des march\u00e9s sur la base du prix le plus avantageux.<\/p>\n

Changement de paradigme dans le droit des march\u00e9s publics<\/h2>\n

Assiste-t-on donc \u00e0 un changement de paradigme dans le droit des march\u00e9s publics, selon lequel ce n'est plus seulement le prix le plus avantageux qui d\u00e9cide ? La Commission de l'\u00e9conomie du Conseil national veut en effet inscrire une plausibilit\u00e9 des offres de dumping dans la r\u00e9vision de la loi f\u00e9d\u00e9rale sur les march\u00e9s publics. C'est ce qu'elle a d\u00e9cid\u00e9 \u00e0 l'unanimit\u00e9 dans le cadre des discussions d\u00e9taill\u00e9es sur la r\u00e9vision du droit des march\u00e9s publics (LMP). Les offres inhabituellement basses devront \u00e0 l'avenir \u00eatre examin\u00e9es de plus pr\u00e8s. \"C'est un bon jour pour l'achat de prestations intellectuelles\", se r\u00e9jouit Heinz Marti, pr\u00e9sident de l'Union suisse des soci\u00e9t\u00e9s d'ing\u00e9nieurs-conseils (usic) et copr\u00e9sident de l'Alliance pour des march\u00e9s publics progressistes (AMP). \"Il faut maintenant que ce changement de paradigme se concr\u00e9tise dans la pratique\". Selon un communiqu\u00e9 de presse, Stefan Cadosch, pr\u00e9sident de la SIA et copr\u00e9sident de l'Afep, se r\u00e9jouit lui aussi : \"La politique a enfin reconnu que les prestations intellectuelles ne peuvent pas \u00eatre achet\u00e9es comme des marchandises standardis\u00e9es\".<\/p>\n

La v\u00e9rification de l'offre comme crit\u00e8re d'attribution<\/h2>\n

Le 31 janvier, la CER-N a fait savoir qu'elle avait l'intention de proposer au Conseil national des mesures efficaces contre les offres de dumping. Par 29 voix contre 0 et 2 abstentions, la commission a d\u00e9cid\u00e9 d'int\u00e9grer dans les crit\u00e8res d'adjudication la demande de l'Afep, une association d'associations et d'organisations dont les membres fournissent des prestations intellectuelles aux pouvoirs adjudicateurs, d'introduire un syst\u00e8me de plausibilit\u00e9 des offres. Il s'agit d'une \u00e9tape importante pour lutter contre les offres de prix absurdes et am\u00e9liorer la qualit\u00e9 des offres. Par 16 voix contre 6 et 2 abstentions, la commission a repris une autre requ\u00eate de l'Afep, selon laquelle les offres anormalement basses doivent \u00eatre examin\u00e9es de mani\u00e8re plus stricte. L'obligation de contr\u00f4le, qui ne s'appliquait jusqu'\u00e0 pr\u00e9sent qu'aux soumissionnaires du secteur public, doit d\u00e9sormais s'appliquer \u00e0 toutes les offres soumises. Les autorit\u00e9s adjudicatrices disposent ainsi d'un instrument efficace leur permettant d'agir contre les offres \u00e0 bas prix.<\/p>\n

Une v\u00e9ritable concurrence en mati\u00e8re de rapport qualit\u00e9-prix se rapproche<\/h2>\n

Elle a en outre pr\u00e9cis\u00e9 que l'expression \"offre \u00e9conomiquement la plus avantageuse\" devait d\u00e9signer l'offre pr\u00e9sentant le meilleur rapport qualit\u00e9-prix. L'Afep a certes demand\u00e9 que cette formulation soit remplac\u00e9e par \"l'offre la plus avantageuse\". Toutefois, cette pr\u00e9cision va dans le sens de l'Alliance, qui exige une v\u00e9ritable concurrence entre prix et prestations dans le droit des march\u00e9s publics au lieu d'une simple concurrence entre prix.<\/p>\n
