Elle a charg\u00e9 son partenaire contractuel APG|SGA 2022 de faire placer de la publicit\u00e9 dans et sur les bus de la STI Bus AG. L'entreprise de transport a refus\u00e9 fin ao\u00fbt 2023 et a renvoy\u00e9 l'agence \u00e0 son contrat avec la SGA.<\/p>\r\n<p>Ils ont \u00e9galement indiqu\u00e9 qu'ils ne se sentaient pas oblig\u00e9s de rendre une d\u00e9cision susceptible de recours, comme le souhaitait l'agence.<\/p>\r\n<p>L'avocat de l'agence s'est ensuite adress\u00e9 \u00e0 l'Office des transports publics et de la coordination des transports du canton de Berne, qui n'a pas souhait\u00e9 s'exprimer sur le sujet. C'est ce qui ressort d'un arr\u00eat du Tribunal administratif f\u00e9d\u00e9ral publi\u00e9 jeudi.<\/p>\r\n<h3><strong>Non comp\u00e9tent<\/strong><\/h3>\r\n<p>Le recours pour d\u00e9ni de justice d\u00e9pos\u00e9 aupr\u00e8s de l'Office f\u00e9d\u00e9ral des transports (OFT) n'a pas fait avancer l'agence, car l'office n'est pas comp\u00e9tent pour le traitement et a transmis le cas au Tribunal administratif f\u00e9d\u00e9ral.<\/p>\r\n<p>Celui-ci n'est pas entr\u00e9 en mati\u00e8re, car le d\u00e9lai de 30 jours pour la transmission d'un tel recours a expir\u00e9. Le tribunal \u00e9crit que la plaignante, d\u00e9j\u00e0 repr\u00e9sent\u00e9e par un avocat en ao\u00fbt 2023, aurait d\u00fb envoyer son recours apr\u00e8s la lettre de la STI Bus.
