Dans son arr\u00eat, la CEDH a reproch\u00e9 \u00e0 une autre assurance d'avoir fait appel \u00e0 des d\u00e9tectives priv\u00e9s pour surveiller une victime d'accident. Elle a estim\u00e9 que les bases l\u00e9gales actuelles en Suisse \u00e9taient insuffisantes pour cela.<\/p>\n<p>La Suva a alors d\u00e9cid\u00e9 de ne plus donner de nouveaux mandats d'observation jusqu'\u00e0 nouvel ordre et de mettre fin \u00e0 toutes les observations en cours. Elle s'en tient \u00e0 cette d\u00e9cision et d\u00e9truira \u00e9galement les documents d'observation d\u00e9j\u00e0 re\u00e7us dans les cas en cours. Il en va de m\u00eame pour les \u00e9valuations m\u00e9dicales \u00e9tablies sur la base de mat\u00e9riel film\u00e9.<\/p>\n<p><strong>La Suva d\u00e9pose un projet de loi<\/strong><\/p>\n<p>Bien que la Suisse puisse encore faire appel de l'arr\u00eat de Strasbourg, l'Office f\u00e9d\u00e9ral des assurances sociales (OFAS) a d\u00e9j\u00e0 annonc\u00e9 qu'il mettrait en consultation d'ici la fin de l'ann\u00e9e une r\u00e9vision de loi correspondante. En outre, la Commission de la s\u00e9curit\u00e9 sociale et de la sant\u00e9 publique du Conseil des Etats (CSSS-E) a d\u00e9cid\u00e9 la semaine derni\u00e8re d'\u00e9laborer \u00e9galement un projet de loi que le Parlement pourrait adopter, dans le cas le plus rapide, \u00e0 l'automne 2017.<\/p>\n<p>La Suva est favorable \u00e0 une d\u00e9cision politique rapide qui r\u00e9glemente clairement le recours aux d\u00e9tectives dans la loi et elle souhaite participer activement au processus politique. Elle a donc d\u00e9j\u00e0 soumis \u00e0 l'OFAS sa propre proposition de formulation d'un article de loi sur le th\u00e8me de la surveillance. Celui-ci r\u00e8gle entre autres les conditions qui autorisent une surveillance et o\u00f9 celle-ci peut avoir lieu.<\/p>\n<p><strong>Renforcement du travail sur le terrain<\/strong><\/p>\n<p>Afin de pouvoir continuer \u00e0 lutter de mani\u00e8re cibl\u00e9e contre les abus jusqu'\u00e0 l'entr\u00e9e en vigueur d'une base l\u00e9gale claire, la Suva veut suivre de mani\u00e8re plus intensive les cas remarquables : Davantage d'examens m\u00e9dicaux, une collaboration renforc\u00e9e avec les autorit\u00e9s ainsi qu'un plus grand nombre d'auditions de t\u00e9moins doivent permettre de clarifier la situation \u00e0 un stade pr\u00e9coce. En outre, en cas de soup\u00e7ons fond\u00e9s, elle veut effectuer des contr\u00f4les plus fr\u00e9quents avec le service ext\u00e9rieur.
