(Image : Depositphotos.com)<\/figcaption>\r\n<\/figure>\r\n<p>Le \"Global Pay Transparency Report\" publi\u00e9 par Mercer se base sur les r\u00e9ponses de plus de 1'000 entreprises du monde entier. Il conclut en substance que la transparence des salaires devient de plus en plus importante pour les entreprises du monde entier, non seulement pour se conformer aux r\u00e9glementations locales dans certains pays, mais aussi pour attirer et retenir les collaborateurs.<\/p>\r\n<h3><strong>La transparence des salaires uniquement sous la pression de la r\u00e9glementation ?<\/strong><\/h3>\r\n<p>Selon l'enqu\u00eate, pour 77 pour cent des entreprises au niveau mondial, la conformit\u00e9 est la principale raison de leur strat\u00e9gie de transparence des salaires. Plus de 50 pour cent consid\u00e8rent l'am\u00e9lioration de la satisfaction des collaborateurs et la conformit\u00e9 avec les valeurs de l'entreprise comme des aspects importants. Les valeurs pour les entreprises suisses co\u00efncident largement avec les r\u00e9sultats globaux.<\/p>\r\n<p>\"Il est temps que les entreprises soient actives en mati\u00e8re de transparence des salaires. Une r\u00e9mun\u00e9ration \u00e9quitable \u00e9tant la deuxi\u00e8me raison la plus importante pour laquelle les collaborateurs choisissent une entreprise. Les employeurs devraient donner la priorit\u00e9 \u00e0 ce fait s'ils veulent continuer \u00e0 faire des affaires avec succ\u00e8s\", d\u00e9clare Mikolaj Jaszczuk, Principal Consultant Rewards chez Mercer Suisse.<\/p>\r\n<h3><strong>Des d\u00e9ficits importants<\/strong><\/h3>\r\n<p>Bien que les employeurs reconnaissent les attentes croissantes en mati\u00e8re de transparence des salaires, il subsiste encore un d\u00e9ficit important dans la mise en \u0153uvre. Moins d'un tiers (32 pour cent) des entreprises ont d\u00e9clar\u00e9 \u00eatre pr\u00e9par\u00e9es \u00e0 r\u00e9pondre aux exigences mondiales en mati\u00e8re de transparence. En Suisse, ce chiffre \u00e9tait de 50 pour cent.<\/p>\r\n<p>Malgr\u00e9 les diff\u00e9rences de l\u00e9gislation en mati\u00e8re de transparence des salaires, les entreprises am\u00e9ricaines sont en t\u00eate et une entreprise sur cinq a mis en place une strat\u00e9gie de transparence des salaires. En Europe (\u00e0 l'exception du Royaume-Uni et de l'Irlande), seules 7% des entreprises ont mis en place une strat\u00e9gie de transparence des salaires, alors que la l\u00e9gislation sur la transparence des salaires dans l'UE entrera en vigueur en 2026.<\/p>\r\n<h3><strong>Principales diff\u00e9rences et limites des exigences actuelles en mati\u00e8re d'\u00e9galit\u00e9 salariale <\/strong><\/h3>\r\n<p>L'exigence suisse en mati\u00e8re d'\u00e9galit\u00e9 salariale, qui fait partie de la loi r\u00e9vis\u00e9e sur l'\u00e9galit\u00e9, constitue certes un pas dans la bonne direction, mais son caract\u00e8re unique et le manque de transparence requis peuvent consid\u00e9rablement limiter son efficacit\u00e9. Dans un article, Mikolaj Jaszczuk et Stefanie Schweitzer, Managing Consultant Rewards and Pay Equity, mettent en lumi\u00e8re les diff\u00e9rences entre la loi suisse sur l'\u00e9galit\u00e9 salariale et la directive europ\u00e9enne sur l'\u00e9galit\u00e9 et l'\u00e9quit\u00e9 salariale. Alors que la Suisse impose une analyse unique de l'\u00e9galit\u00e9 salariale, l'UE mise sur un contr\u00f4le continu pour garantir l'\u00e9galit\u00e9 \u00e0 long terme.<\/p>\r\n<p>La loi suisse sur l'\u00e9galit\u00e9, r\u00e9vis\u00e9e en 2020, exige des entreprises de plus de 100 employ\u00e9s une analyse unique de l'\u00e9galit\u00e9 salariale. Celle-ci doit \u00eatre r\u00e9alis\u00e9e \u00e0 l'aide d'une m\u00e9thode valid\u00e9e scientifiquement et faire l'objet d'un contr\u00f4le externe. Les entreprises qui r\u00e9ussissent l'examen ne doivent pas effectuer d'autres analyses. Il manque donc un m\u00e9canisme de contr\u00f4le et de d\u00e9veloppement r\u00e9gulier, ce qui fait perdre \u00e0 la loi son efficacit\u00e9.<\/p>\r\n<p>En revanche, la directive europ\u00e9enne oblige les entreprises \u00e0 effectuer des analyses r\u00e9guli\u00e8res - tous les ans ou tous les trois ans, selon la taille de l'entreprise. En outre, elle encourage la transparence en obligeant les entreprises \u00e0 divulguer des informations sur les salaires, ce qui devrait conduire \u00e0 une structure salariale plus \u00e9quitable. Les candidats ont \u00e9galement le droit de recevoir des informations sur les structures salariales, tandis que les employeurs ne sont pas autoris\u00e9s \u00e0 demander des informations sur l'historique des salaires. Cela r\u00e9duit les asym\u00e9tries d'information entre les entreprises et les employ\u00e9s.<\/p>\r\n<h3><strong>La Suisse devrait-elle revoir son mod\u00e8le ?<\/strong><\/h3>\r\n<p>L'article de Mercer identifie quatre diff\u00e9rences majeures entre la r\u00e9glementation suisse et la directive europ\u00e9enne :<\/p>\r\n<ol>\r\n\t<li><strong>Fr\u00e9quence des analyses :<\/strong> Alors que la Suisse exige un examen unique, l'UE mise sur une surveillance continue.<\/li>\r\n\t<li><strong>M\u00e9thode d'analyse :<\/strong> La Suisse exige une analyse de r\u00e9gression valid\u00e9e scientifiquement, tandis que l'UE impose un contr\u00f4le plus g\u00e9n\u00e9ral de l'\u00e9galit\u00e9 salariale.<\/li>\r\n\t<li><strong>Port\u00e9e et transparence :<\/strong> L'UE accorde une grande importance \u00e0 la transparence en obligeant les entreprises \u00e0 divulguer des informations sur les salaires. La Suisse n'exige qu'une communication interne des r\u00e9sultats.<\/li>\r\n\t<li><strong>Suivi et contr\u00f4le :<\/strong> En Suisse, il n'existe pas d'organisme de surveillance officiel. En revanche, l'UE oblige les Etats membres \u00e0 mettre en place des organismes de surveillance qui garantissent le respect des prescriptions.<\/li>\r\n<\/ol>\r\n<p>Les auteurs concluent que l'analyse unique en Suisse ne suffit pas \u00e0 garantir une \u00e9galit\u00e9 salariale durable. Alors que la directive europ\u00e9enne peut entra\u00eener un changement profond de la structure salariale, le mod\u00e8le suisse reste un instrument ponctuel sans effet \u00e0 long terme.
