(Photo : Fabian Steiner)<\/figcaption><\/figure>\n<p>La conf\u00e9rence de cette ann\u00e9e sur les march\u00e9s publics dans le domaine de l'informatique s'est pench\u00e9e sur le changement num\u00e9rique du point de vue du l\u00e9gislatif, du judiciaire et de la pratique. La r\u00e9vision de la loi sur les march\u00e9s publics de la Conf\u00e9d\u00e9ration ainsi que des solutions innovantes pour les syst\u00e8mes de billetterie dans les transports publics ont fait l'objet de pr\u00e9sentations. La conf\u00e9rence sur les march\u00e9s publics informatiques s'adresse aux acheteurs, aux fournisseurs, aux conseillers et aux juristes qui travaillent dans le domaine des march\u00e9s publics. Elle est organis\u00e9e par le Centre de recherche sur la durabilit\u00e9 num\u00e9rique de l'Universit\u00e9 de Berne, l'Unit\u00e9 de pilotage informatique de la Conf\u00e9d\u00e9ration UPIC, la Conf\u00e9rence suisse sur l'informatique CSI, swissICT et CH Open.<\/p>\n<h2><strong>La LMP dans les m\u00e9andres de la loi<\/strong><\/h2>\n<p>La conseill\u00e8re nationale Kathrin Bertschy a donn\u00e9 au pl\u00e9num un aper\u00e7u des coulisses l\u00e9gislatives. Le principe \"bon march\u00e9 n'est pas toujours bon march\u00e9\" a guid\u00e9 jusqu'ici les d\u00e9bats sur la r\u00e9vision de la loi sur les march\u00e9s publics. Les dispositions contraignantes propos\u00e9es en mati\u00e8re de durabilit\u00e9 et de transparence (co\u00fbts du cycle de vie et principe de transparence) ont \u00e9t\u00e9 accept\u00e9es par le Conseil national. Les d\u00e9lib\u00e9rations du Conseil des Etats, au cours desquelles ces points et d'autres points controvers\u00e9s, tels que l'assujettissement des entreprises publiques et la r\u00e9glementation de la r\u00e9cusation, seront mis au banc d'essai, sont encore attendues. Le calendrier le montre : La nouvelle loi n'est pas attendue avant 2020.<\/p>\n<p>Le juge Marc Steiner a \u00e9galement soulign\u00e9 l'importance de la transparence comme principe directeur de la r\u00e9vision. Au moyen d'arr\u00eats du Tribunal administratif f\u00e9d\u00e9ral, il a montr\u00e9 comment la jurisprudence se r\u00e9percute sur les efforts l\u00e9gislatifs et inversement. La pr\u00e9sentation a mis l'accent sur les aspects de bonne gouvernance. L'acquisition de technologies de l'information, en particulier, est sujette \u00e0 des adjudications peu scrupuleuses et \u00e0 des abus. La lutte contre la corruption sera d\u00e9sormais inscrite dans les objectifs de la loi. Il s'agit certes d'un signal fort, mais les d\u00e9tails ne sont pas encore au point : la r\u00e9glementation de la r\u00e9cusation (art. 13) propos\u00e9e par le Conseil f\u00e9d\u00e9ral est par exemple \"un scandale\". En conclusion, il a montr\u00e9 que le changement de paradigme de la concurrence par les prix \u00e0 la concurrence par la qualit\u00e9 ne fait pas seulement partie de la r\u00e9vision, mais qu'il est \u00e9galement un sujet de jurisprudence.<\/p>\n<h2><strong>Transformation num\u00e9rique pour le public<\/strong><\/h2>\n<p>Les innovations ne sont pas seulement pouss\u00e9es par les pouvoirs l\u00e9gislatif et judiciaire, mais aussi par la pratique. Ainsi, la start-up FAIRTIQ r\u00e9volutionne le syst\u00e8me de billetterie dans les transports publics. Son fondateur, Gian-Mattia Schucan, est l'ancien responsable de la billetterie aux CFF et prouve, avec sa nouvelle application, comment les processus actuels peuvent \u00eatre fondamentalement boulevers\u00e9s par la transformation num\u00e9rique. Le projet lanc\u00e9 par le centre de recherche sur la durabilit\u00e9 num\u00e9rique promet une autre r\u00e9volution. <a href=\"http:\/\/www.intelliprocure.ch\/\">www.intelliprocure.ch<\/a>. Cette plateforme offre plus d'intelligence dans le processus d'achat gr\u00e2ce \u00e0 l'analyse des donn\u00e9es Simap. Du c\u00f4t\u00e9 de simap.ch aussi, il y a des nouveaut\u00e9s. Thomas Fischer, membre du comit\u00e9 directeur de simap.ch et responsable de la conf\u00e9rence sur les achats du canton de Berne, a pr\u00e9sent\u00e9 le projet simap2019. La plateforme d'e-procurement modulaire bas\u00e9e sur l'open source doit \u00eatre mise en ligne le 1er mai 2019.
