Le processus est le suivant : La personne concern\u00e9e r\u00e9pond \u00e0 un formulaire en ligne (www.au-schein.de<\/a>) quelques questions sur les sympt\u00f4mes. Un m\u00e9decin \u00e9tablit le diagnostic et envoie le certificat d'incapacit\u00e9 de travail au patient par Whatsapp. Il convient de noter, \u00e0 titre de restriction, que l'utilisation de ce service en ligne est actuellement (encore) limit\u00e9e aux rhumes et que la dur\u00e9e maximale de l'incapacit\u00e9 de travail confirm\u00e9e est de trois jours.<\/p>\n

La situation juridique : il incombe au patient de prouver \u00e0 son employeur l'existence d'une incapacit\u00e9 de travail. Cette preuve est normalement - mais pas obligatoirement - apport\u00e9e par un certificat m\u00e9dical. La pratique judiciaire part du principe qu'un certificat m\u00e9dical est exact tant qu'aucun doute fond\u00e9 ne peut \u00eatre \u00e9veill\u00e9 \u00e0 son sujet. Comme le \"docteur Whatsapp\" n'a aucun contact personnel ou t\u00e9l\u00e9phonique avec le patient, des doutes peuvent \u00eatre tout \u00e0 fait justifi\u00e9s et avoir des r\u00e9percussions sur la valeur probante d'un tel certificat d'incapacit\u00e9 de travail.<\/p>\n

Une disposition du contrat de travail selon laquelle les certificats de t\u00e9l\u00e9m\u00e9decine (sans visite m\u00e9dicale) ne sont pas accept\u00e9s peut tout au plus avoir un effet \"pr\u00e9ventif\". D'un point de vue juridique, une exclusion g\u00e9n\u00e9rale ne serait toutefois gu\u00e8re compatible avec la libre appr\u00e9ciation des preuves par le juge. De m\u00eame, un examen par un m\u00e9decin-conseil n'est g\u00e9n\u00e9ralement pas un moyen appropri\u00e9 en cas d'absences de courte dur\u00e9e.<\/p>\n

Conseil pratique : pourquoi ne pas demander un certificat m\u00e9dical seulement \u00e0 partir du quatri\u00e8me (ou cinqui\u00e8me) jour de maladie ? Les \"certificats Whatsapp\" deviendraient ainsi superflus. De toute fa\u00e7on, le mieux est de chercher tout simplement le dialogue avec les personnes concern\u00e9es en cas d'absences remarquables ou \"peu claires\".<\/p>\n
