(Image : Pixabay.com)<\/figcaption><\/figure>\n<p>La situation exceptionnelle d\u00e9cr\u00e9t\u00e9e par le Conseil f\u00e9d\u00e9ral a des cons\u00e9quences existentielles pour de nombreuses PME. L'instrument du ch\u00f4mage partiel est pr\u00e9vu pour les pertes de travail d'origine \u00e9conomique - dont font \u00e9galement partie celles qui sont dues \u00e0 des mesures prises par les autorit\u00e9s.<\/p>\n<h2>Quel est le but du ch\u00f4mage partiel ?<\/h2>\n<p>Le ch\u00f4mage partiel a pour but d'\u00e9viter qu'en cas de difficult\u00e9s \u00e9conomiques non imputables \u00e0 l'employeur lui-m\u00eame, une entreprise puisse continuer \u00e0 employer ses collaborateurs et ne doive pas les licencier. Le ch\u00f4mage de masse peut ainsi \u00eatre \u00e9vit\u00e9 \u00e0 moyen terme. Les salari\u00e9s conservent donc \u00e9galement leur protection sociale et les lacunes de cotisation \u00e0 la pr\u00e9voyance professionnelle sont ainsi \u00e9vit\u00e9es. Les employeurs ont l'avantage de pouvoir \u00e9conomiser les co\u00fbts li\u00e9s \u00e0 la fluctuation du personnel et de garantir la disponibilit\u00e9 de leurs employ\u00e9s gr\u00e2ce au ch\u00f4mage partiel.<\/p>\n<h2>Quand peut-on demander le ch\u00f4mage partiel ?<\/h2>\n<p>Si une entreprise doit introduire le ch\u00f4mage partiel, elle doit s'annoncer aupr\u00e8s du canton au moins 10 jours avant le d\u00e9but du ch\u00f4mage partiel. En raison de l'actualit\u00e9, ce d\u00e9lai est d\u00e9sormais r\u00e9duit \u00e0 3 jours. Le canton examine ensuite la l\u00e9galit\u00e9 de la demande.<\/p>\n<h2>Qui peut demander le ch\u00f4mage partiel ?<\/h2>\n<p>La demande est faite par l'employeur. Les employ\u00e9s n'ont rien \u00e0 faire eux-m\u00eames, mais doivent g\u00e9n\u00e9ralement signer une d\u00e9claration d'accord.<\/p>\n<h2>Quand n'y a-t-il pas de droit \u00e0 l'indemnit\u00e9 de ch\u00f4mage partiel ?<\/h2>\n<p>Les arr\u00eats de travail qui ne sont pas temporaires ne sont pas couverts par le ch\u00f4mage partiel. Il en va de m\u00eame pour les arr\u00eats de travail qui font partie des risques normaux de l'entreprise ou qui sont n\u00e9cessaires \u00e0 l'organisation de l'entreprise (par exemple, les interruptions d'activit\u00e9 pour des travaux de r\u00e9paration, de transformation, de nettoyage ou autres). Les fluctuations saisonni\u00e8res de l'emploi ne sont pas non plus \u00e9ligibles.<\/p>\n<p>En outre, les collaborateurs engag\u00e9s pour une dur\u00e9e d\u00e9termin\u00e9e (ils continuent \u00e0 percevoir l'int\u00e9gralit\u00e9 de leur salaire) ou ceux dont les rapports de travail ont \u00e9t\u00e9 r\u00e9sili\u00e9s n'y ont pas droit. Les propri\u00e9taires, associ\u00e9s ou autres personnes participant financi\u00e8rement \u00e0 l'entreprise n'ont pas non plus droit aux indemnit\u00e9s de ch\u00f4mage partiel.<\/p>\n<h2>O\u00f9 faut-il s'inscrire ?<\/h2>\n<p>Les interlocuteurs sont les services cantonaux comp\u00e9tents ; en r\u00e8gle g\u00e9n\u00e9rale, ils sont rattach\u00e9s \u00e0 la direction cantonale de l'\u00e9conomie publique concern\u00e9e.<\/p>\n<h2>Quel est le montant de l'indemnit\u00e9 en cas de r\u00e9duction de l'horaire de travail ?<\/h2>\n<p>L'indemnit\u00e9 est fonction du taux d'occupation r\u00e9duit de l'employeur. Ainsi, si un poste \u00e0 100 % est r\u00e9duit \u00e0 50 %, l'indemnit\u00e9 de ch\u00f4mage partiel s'\u00e9l\u00e8ve \u00e0 80 % du salaire supprim\u00e9 (<a href=\"https:\/\/www.ch.ch\/de\/kurzarbeit\/\">Exemple de calcul<\/a>). Les cotisations AVS\/AI\/AC\/APG continuent d'\u00eatre pay\u00e9es \u00e0 parts \u00e9gales par l'employeur et l'employ\u00e9, le salaire assur\u00e9 \u00e9tant d\u00e9terminant.<\/p>\n<h2>Si l'on tombe malade en cas de ch\u00f4mage partiel : Quel est le salaire vers\u00e9 par l'assurance d'indemnit\u00e9s journali\u00e8res en cas de maladie ?<\/h2>\n<p>Si un employ\u00e9 tombe malade pendant son temps de travail r\u00e9duit, les assureurs d'indemnit\u00e9s journali\u00e8res de maladie ont des r\u00e8gles diff\u00e9rentes. La plupart du temps, les prestations sont calcul\u00e9es sur la base du salaire r\u00e9duit, auquel s'ajoute la perte d'indemnisation par l'assurance ch\u00f4mage.
