Il produttore francese di profumi Maison Jean Patou ha presentato un'opposizione sulla base del proprio marchio \"Joy\". L'EUIPO si \u00e8 pronunciato parzialmente a suo favore.<\/p>\r\n<p>Kneipp si \u00e8 difesa presso il Tribunale dell'UE - senza successo, come ora \u00e8 stato stabilito. I giudici hanno stabilito che il marchio \"Joy\" godeva di un'elevata reputazione in una parte significativa dell'UE, in particolare in Francia. Il marchio aveva acquisito un'elevata reputazione in passato.<\/p>\r\n<p>Anche se il grado di riconoscimento \u00e8 diminuito nel corso degli anni, \u00e8 sopravvissuta una certa \"consapevolezza residua\". I due marchi erano cos\u00ec simili da poter essere associati l'uno all'altro nella mente.
