Il 15 febbraio 2017, il Consiglio federale ha adottato il messaggio sulla revisione totale della Legge federale sugli appalti pubblici (B\u00f6B). Uno degli obiettivi principali della revisione \u00e8 quello di armonizzare le normative sugli appalti della Confederazione e dei Cantoni. Parallelamente, il Consiglio federale ha adottato il messaggio sulla revisione dell'Accordo OMC sugli appalti pubblici del 2012 (GPA). Il nuovo accordo migliora la trasparenza e l'accesso al mercato e sostituisce l'accordo originale del 1994. Alla fine di gennaio 2018, la Commissione per gli Affari Economici del Consiglio Nazionale (WAK-N) ha preso alcune decisioni rivoluzionarie nel corso delle sue consultazioni dettagliate, in particolare per quanto riguarda l'aggiudicazione dei contratti in base al prezzo pi\u00f9 basso.<\/p>\n

Cambio di paradigma nel diritto degli appalti<\/h2>\n

Ci sar\u00e0 quindi un cambiamento di paradigma nella normativa sugli appalti, per cui il prezzo pi\u00f9 economico non sar\u00e0 pi\u00f9 l'unico fattore decisivo? La Commissione economica del Consiglio nazionale vuole introdurre un controllo di plausibilit\u00e0 per le offerte di dumping nella revisione della Legge federale sugli appalti pubblici. Ci\u00f2 \u00e8 stato deciso all'unanimit\u00e0 nel corso delle citate consultazioni dettagliate sulla revisione della legge sugli appalti (B\u00f6B). In futuro, le offerte insolitamente basse dovranno essere esaminate pi\u00f9 attentamente. \"Oggi \u00e8 un buon giorno per gli appalti di servizi intellettuali\", ha dichiarato Heinz Marti, presidente dell'Associazione delle societ\u00e0 di ingegneria di consulenza usic e co-presidente dell'Alleanza per gli appalti pubblici progressisti (Af\u00f6B). \"Ora questo cambiamento di paradigma deve essere attuato anche nella pratica\". Stefan Cadosch, presidente dell'ASI e co-presidente dell'Af\u00f6B, si rallegra, secondo un comunicato stampa: \"I politici hanno finalmente riconosciuto che i servizi intellettuali non possono essere acquistati come beni standardizzati\".<\/p>\n

La plausibilit\u00e0 dell'offerta come criterio di aggiudicazione<\/h2>\n

Il 31 gennaio il WAK-N ha annunciato l'intenzione di presentare una proposta al Consiglio Nazionale del Lavoro per l'adozione di misure efficaci contro le offerte di dumping. Con 29 voti favorevoli, 0 contrari e 2 astensioni, la Commissione ha deciso di includere la richiesta dell'Af\u00f6B, un'associazione di associazioni e organizzazioni i cui membri offrono servizi intellettuali alle amministrazioni aggiudicatrici pubbliche, di introdurre un controllo di plausibilit\u00e0 delle offerte nei criteri di aggiudicazione. Si tratta di un passo importante per combattere le offerte di prezzo senza senso e per migliorare la qualit\u00e0 delle offerte. La Commissione ha adottato con 16 voti favorevoli, 6 contrari e 2 astensioni un'altra preoccupazione dell'Af\u00f6B, secondo la quale le offerte insolitamente basse devono essere controllate pi\u00f9 rigorosamente. L'obbligo di verifica, che in precedenza si applicava solo agli offerenti del settore pubblico, si applica ora a tutte le offerte presentate. Questo dar\u00e0 alle autorit\u00e0 aggiudicatrici un potente strumento per intervenire contro le offerte puramente a basso prezzo.<\/p>\n

La vera competizione prezzo-prestazioni si avvicina<\/h2>\n

Inoltre, la Commissione ha chiarito che per \"offerta economicamente pi\u00f9 vantaggiosa\" si intende l'offerta con il miglior rapporto qualit\u00e0-prezzo. L'Af\u00f6B ha chiesto di sostituire la dicitura con \"offerta pi\u00f9 vantaggiosa\". Tuttavia, il chiarimento \u00e8 nello spirito dell'Alleanza, che chiede una vera e propria concorrenza prezzo-prestazione nella normativa sugli appalti, anzich\u00e9 una pura concorrenza sui prezzi.<\/p>\n
