Nella sua sentenza, la Corte europea dei diritti dell'uomo ha rimproverato un'altra compagnia di assicurazioni per aver usato investigatori privati per monitorare una vittima di un incidente. L'attuale base giuridica in Svizzera era insufficiente per questo.<\/p>\n<p>La Suva ha poi deciso di non emettere nuovi ordini di osservazione fino a nuovo avviso e di interrompere tutte le osservazioni in corso. Si attiene a questa decisione e di conseguenza distrugger\u00e0 anche i documenti di osservazione gi\u00e0 ricevuti dai casi in corso. Questo vale anche per le valutazioni mediche fatte sulla base di materiale filmato.<\/p>\n<p><strong>La Suva presenta un progetto di legge<\/strong><\/p>\n<p>Anche se la Svizzera pu\u00f2 ancora appellarsi alla sentenza di Strasburgo, l'Ufficio federale delle assicurazioni sociali (UFAS) ha gi\u00e0 annunciato che mander\u00e0 in consultazione una corrispondente revisione della legge entro la fine dell'anno. Inoltre, la Commissione della sicurezza sociale e della salute del Consiglio degli Stati (SGK-S) ha deciso la settimana scorsa di preparare anche un progetto di legge, che nel caso pi\u00f9 rapido potrebbe essere approvato dal parlamento nell'autunno 2017.<\/p>\n<p>La Suva accoglie con favore una decisione politica rapida che regoli chiaramente l'uso dei detective per legge, e vuole partecipare attivamente al processo politico. Ha quindi gi\u00e0 presentato la propria proposta all'UFAS per un articolo di legge sul tema della sorveglianza. Questo regola, tra le altre cose, quali condizioni permettono la sorveglianza e dove pu\u00f2 avvenire.<\/p>\n<p><strong>Aumento del lavoro sul campo<\/strong><\/p>\n<p>Affinch\u00e9 la Suva possa continuare a combattere gli abusi in modo mirato fino all'entrata in vigore di una chiara base legale, vuole monitorare pi\u00f9 intensamente i casi cospicui: Pi\u00f9 esami medici, una maggiore cooperazione con le autorit\u00e0 e pi\u00f9 interviste con i testimoni dovrebbero fornire chiarezza in una fase iniziale. Inoltre, vuole effettuare ispezioni pi\u00f9 frequenti con il personale sul campo se ci sono ragionevoli motivi di sospetto.
